Going 88 mph might not send you back in time, but it’s unlikely to be reckless driving.

Anne Arundel County drivers, and drivers throughout the State of Maryland for that matter, need to understand the consequences that a serious traffic conviction can have on your license.   Most of our clients who come in for free consultations know the serious nature of being accused of breaking the DUI laws, Driving while Suspended, Fleeing and Eluding, or Driving Uninsured.  All these infractions carry jail time and we highly recommend you consult an Anne Arundel County Traffic Lawyer before going it alone in court.

However, there are also some serious traffic violations that do not carry jail time, but have a disastrous effect on your license if you’re not careful, namely: Reckless Driving and Negligent Driving.  Both of these violations are charged by citation, so you would think not so bad, right? Wrong…  What exactly are these violations and what should you do if you’re charged with one or both of them?

Anne Arundel County Traffic Lawyer: What is Reckless Driving?

One may be convicted of Reckless Driving if you drive a motor vehicle:

  1. In wanton or willful disregard for the safety of persons or property; or
  2. In a manner that indicates a wanton or willful disregard for the safety of persons or property.

The Penalty for Reckless driving with or without an accident is 6 points and $560.00 fine.

Anne Arundel County Traffic Lawyer: What is Negligent Driving?

One may be convicted of Negligent Driving if you drive a motor vehicle in a careless or imprudent manner that endangers any property or the life or person of any individual. Negligent Driving is basically Reckless Driving light.

If no accident is involved, Negligent Driving carries 1 point, $140.00 fine, however if an accident is involved it is 3 points and a $280.00 fine.

Do I need a lawyer for Negligent Driving?

In short it’s the points (see above). Once your license has more than two points on it, you are entering a very slippery slope to massive MVA headaches, Driver Improvement Classes, and possibly a suspended license.  You can’t afford that, because we all need to drive to maintain our lifestyles.  An Anne Arundel County Traffic Lawyer can help you avoid those points and pitfalls.

I’ve been charged with Reckless Driving, now what?

If you pay the ticket immediately, you have just entered into a consent judgment, which is not exactly a guilty plea but has the exact same legal effect. You will be automatically assessed the points, and lose the opportunity to petition the court for PBJ (Probation before Judgment), a lower fine, and possibly a dismissal, all of which would help you avoid the points.

Having a lawyer who is experienced in the process can be helpful as police officers are more likely to negotiate with the lawyer to avoid a trial or offer a different citation. At ENLawyers, we negotiate with the police officers regularly. Call us for your free consultation concerning all your serious traffic violations including Reckless Driving and Negligent Driving.
